Use of Software

Use of the software that is made available for downloading is governed by the terms and conditions of the License Agreement that accompanies it.

You must read the License Agreement and accept to be bound by all its terms and conditions before installing, copying or otherwise using the software. If you cannot find, read or understand the License Agreement, or if you do not agree to all its terms and conditions, you may not install, copy or otherwise use the software.

You agree that you are solely responsible for identifying and complying with any laws, regulations, restrictions and controls that may be applicable to you concerning the import, possession, use and re-export of the software, and for obtaining any licenses, permits or approvals that might be required.

Online Store

Noemax has contracted element 5, a Digital River company, to resell its products and services. The parts of the Online Store where orders are placed, customer service is provided, and in general any pages that originate from any element 5 Web site, are operated and supported by element 5 and are under its sole, direct and independent control. Read the element 5 Legal Notice, Privacy Statement and Terms and Conditions.

Any information entered in those pages is sent directly to element 5, without any intervention by Noemax. Credit card information and other payment details are not provided by element 5 to Noemax.

Noemax does not accept any responsibility under any circumstances and disclaims all warranties, express or implied, for financial transactions and any other use, actions, operations or practices (including but not limited to security measures and privacy policies) that are controlled by or are the responsibility of element 5.

Your Account

Your Account enables you to access restricted areas of this Web site. You may open multiple accounts using different e-mail addresses. You may not provide your login information to anyone else or otherwise share your account with anyone else. Opening an account will automatically subscribe you to the Noemax newsletter, from which you can unsubscribe at any time with immediate effect.

To download the Noemax products for which you have purchased a license and to receive support for them, you must open an account and register there your license keys within thirty (30) days of receiving them.

Registering a license key enables you to access the support and maintenance services for the licensed product. If the License Agreement of that product permits its use by multiple persons, then you are entitled to download the product and ask for support on behalf of the other licensed persons.

Each license key can only be registered once and in a single account. A subscription renewal can only be registered in the same account as the product it is intended for. The starting date of a subscription renewal is the expiration date of the previous subscription being renewed.

User Materials

Except for personal information as explicitly stated in our Privacy Policy, all messages, materials and information that you send to this Web site by e-mail message, online form submission, posting, uploading or any other means of communication, are deemed to be, and treated as, non-confidential and non-proprietary.

By sending any such materials or information, you automatically grant Noemax an unrestricted, irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to have derivative works created from those materials or information and to freely use, reproduce, display, perform, modify, sublicense, transmit and distribute in any form and by any means those materials or information including any ideas, concepts, know-how and techniques they may contain for any purpose.
